Terms of Service

1. Provider and scope

These Terms of Service apply to the use of the “OurSnaps” service, available at oursnaps.app, provided by Dawid Nachlik, Poland (“we”, “us”). They apply to all users. Any conflicting or different terms of a user do not become part of the agreement unless we expressly agree to them.

2. The service

OurSnaps is a web app for shared event photo galleries (e.g. weddings, parties). The organizer creates a gallery; guests upload photos via a QR code and see them in a shared live gallery – without installing an app and without an account.

The exact scope of the service (number of guests and photos, and how long the gallery stays available) depends on the selected plan. There is a free plan and paid plans with extended limits.

3. Eligibility and agreement

You must be at least 18 years old (or the age of majority where you live) to create an account or buy a paid plan. Guests who upload photos without an account must be at least 13 years old.

Creating an account or a gallery forms a free agreement for the use of the service. When you choose a paid plan and click the payment button, you place a binding order. The agreement for the paid plan is concluded once the payment provider confirms the payment.

4. Prices and payment

The prices shown on the website at the time of your order apply. Prices are final prices in US dollars (USD). Each paid plan is a one-time payment per event – not a subscription.

Payments are processed by our payment provider Stripe. You can use the payment methods shown at checkout (e.g. credit card, Apple Pay, Google Pay). The terms of the respective payment provider also apply.

5. Activation and storage period

After successful payment, the selected plan is activated for the gallery right away. Galleries and photos are automatically and permanently deleted when the plan’s storage period ends (between 14 and 90 days from the event date, depending on the plan). You are responsible for downloading and backing up any photos that matter to you in time.

6. Your responsibilities and content

You agree not to upload content that is illegal, offensive, harmful to minors or that infringes the rights of others. By uploading photos, you confirm that you have the right to share them and that the people shown agree to being shown in the gallery.

You keep all rights to the photos you upload. You grant us a non-exclusive right, limited to providing the service, to store the photos and display them within the respective gallery. We may remove content that violates these terms or applicable law.

7. Availability

We work to keep the service highly available but cannot guarantee uninterrupted availability. Maintenance, outages at third-party providers (e.g. hosting) or force majeure may cause temporary limitations.

8. Liability

We are fully liable for intent and gross negligence and for injury to life, body or health. In all other cases, our total liability is limited to the amount you paid us for the affected event, to the extent permitted by law.

We are not liable for content uploaded by users. Nothing in these terms limits any liability that cannot be limited under applicable law.

9. Refunds and right of withdrawal

Details on refunds – including the statutory right of withdrawal for consumers in the European Union – are set out in our Refund Policy.

10. Changes to these terms

We may change these terms for the future where there is a valid reason (e.g. changes in the law or in features) and the change does not unreasonably disadvantage you. Orders already placed remain subject to the terms agreed at the time of the order.

11. Governing law and final provisions

These terms are governed by the laws of the Republic of Poland, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, the mandatory consumer protection laws of the country where you live remain unaffected. If any provision of these terms is or becomes invalid, the remaining provisions remain in effect.
